AWR: agency workers regulations for contractors
Last updated:
AWR (2010) gives agency workers equal treatment on basic working conditions after 12 weeks in the same role. Most limited-company contractors never think about it — until an agency invokes it to justify a pay model.
Who it applies to
Genuinely self-employed contractors (outside IR35, own company) are generally out of scope. Umbrella workers are agency workers for AWR purposes — in scope.
The 12-week clock and the PBA trap
After 12 weeks, umbrella workers qualify for the same pay as a comparable permanent employee. Agencies neutralise this with Pay Between Assignments (PBA) contracts: a guaranteed wage across gaps in exchange for AWR parity mostly evaporating. A PBA contract trades income smoothing for rights — decide deliberately, and always compare net outcomes, not headline rates.
For most outside-IR35 contractors AWR is background noise; for umbrella-based inside-IR35 work it's the reason pay structures differ between agencies. Status first: see the evidence guide.
How the 12 weeks actually count
The qualifier clock counts 12 calendar weeks in the same role with the same hirer, counting weeks with any part of a week worked, pausing (up to 6 weeks break) rather than resetting, and resetting only on role change or a 6-week+ gap. Rolling 12-week-on/11-off patterns to dodge AWR were specifically closed for most structures — the hiring pattern, not the contract wording, decides.
PBA contracts: the trade in full
Pay Between Assignments guarantees pay during gaps (usually a reserve rate) in exchange for modifying the equal-pay right. Whether that's good value depends entirely on gap risk: stable renewals → parity wins; lumpy project work → the guarantee has real value. Model both with the calculator before signing either contract shape.
AWR vs IR35: different questions
AWR asks "are you an agency worker for rights purposes"; IR35 asks "are you taxed as an employee". You can be outside IR35 (self-employed for tax) yet in AWR scope in edge cases, and most commonly inside IR35 umbrella workers are in both. The status layer comes first — evidence guide.
The equal-pay comparator, demystified
AWR parity compares you against a comparable permanent employee of the hirer: same or broadly similar work. The hirer must provide the information the agency needs — in practice agencies resist, and the 12-week parity claim becomes a data-request exercise. If you're umbrella-based on a long engagement, put the comparator request in writing at week 10; the paper trail does the negotiating later.
Between engagements: what the PBA actually pays
PBA "between-assignment pay" is typically minimum-wage-flavoured, not a pro-rata of your rate — the guarantee is thinner than the brochure implies. Check the schedule: hours guaranteed per week, the rate, and how gaps end (new assignment signed = PBA ends = your rate resumes). Model a realistic year of gaps before choosing PBA over straight parity.
